PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE. All users of this site agree that access to and use of this site is subject to the following terms and conditions and a binding contract under Kansas law and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Declaration of Buyer: "I acknowledge this dealer does not authorize that I may lawfully purchase, possess, carry or operate bows, crossbows, paint pistols, air pistols, air rifles, black powder items, or any other items which I may purchase, is in accordance with my state and local laws. I understand the legality of the merchandise I am ordering and I declare that I am of legal age and have no other legal disabilities." We DO NOT warranty that you may purchase or possess handgun components, long gun components, or ammunition according to state or local laws. By agreeing to the terms & conditions, you are stating that you are of legal age to purchase the components or ammunition. This certifies that you are an adult and under no legal disability as provided under 18 U.S.C 922D (1) - (7).

PRICES - Prices and specifications are subject to change without notice. Errors including descriptive, photographic and/or typographic are subject to correction.

Promotions
All promotions are subject to availability and inventory. JM Company Unlimited LLC, reserves the right to change, alter, or cancel promotions at any time without notice.

RESTRICTED ITEMS - Federal, State or Local law may restrict some of the products available from J M Company Unlimited LLC. We do not authorize nor grant the right to purchase products, which may be regulated in your area. You must be at least 21 years of age to purchase products such as ammunition, black powder products, and reloading components. Persons with a legal disability may also be restricted from purchasing certain items as defined under 18 U.S.C. 922(D)(1)-(9). When purchasing from J M Company Unlimited LLC., you warrant that you have read this information, are of legal age and fully compliant with all regulations that might apply for any restricted items.

AGE VERIFICATION 
1.     Adequate age verification has previously been sent. (Choose this option if you want us to wait for your ID to arrive. PLEASE, leave a note in the special instructions section during your order transaction, saying you are forwarding age verification, or E-mail us.)

2.     I submit that it is legal for me to purchase ammunition. This option requires that you be at least 21 years old. A $3.75 fee for this option will be added to your order. (UPS Adult Signature on delivery) Be prepared for someone to receive the package when it is delivered. Once Age Verification is on file, then you will not need to bother with it again unless you move. 

(1) Fax an ENLARGED color photo copy of a government ID. (Scanned DL's do not fax well. See below for E-mail attachment) This ID is commonly a Driver's License but it can also be a Firearms Permit, an FFL, or a Government ID that is current, has a Date of Birth and an Identification #. Any ID that has the Identification # scratched off will not be accepted.  Fax # is: 785-286-0645

If you would like confirmation, please include an E-mail address and a note stating you would like to be notified when your ID arrives. 

(3) A scanned image (Government ID), attached to E-mail, is one of our favorite ways to receive ID as long as you follow these basic rules. It can be color or gray scale, must be low resolution and in compressed file format, such as jpeg(jpg), tiff(tif), gif, or a bmp file if it is not too large. It must be an image file only. If it takes longer than 6 minutes for us to download then we will ask you to reduce it's size before attempting to download it. Write down our E-mail address.  bhersh@jmcoguns.com 

UPS will attempt to make three deliveries, (Leaving a yellow notice) if no one is available to sign, before shipping the product back to us. The shipping fees on undeliverable packages are the responsibility of the customer. If you receive the yellow notice from UPS or have chosen the Adult Signature option, please make arrangements to receive the package.

OUR COMPANY SECURITY: In order to prevent illegal and improper orders we have implemented a system of security checks , including a Security Dept. We do not process every order that comes in without first going through this security system. The main objective of our Security Dept. is to only accept orders that are complete, with no loose ends. For example:

If there are any of the following security snags in your order, you can bet it will be delayed or denied, no matter how small or how large the order is. Simply put, be careful to help us fill your order/s as smoothly as possible.

(1) Wrong or no phone #, especially if the E-mail is incorrect.
(2) A continuous flow of orders to a single customer, using the Adult Signature Option, and especially if there is no concern for price, such as discounts.
(3) A mail in order, using the Adult Signature option. All Mail In orders must include Age Verification, such as a signed and dated statement of Date of Birth or copy of a Driver's License.
(4) Not being able to match the Credit Card's billing address to an address supplied by the customer. This works like a Credit Card password, which after repeated contacts with the customer and address verification attempts, the order will just not be processed.
(5) Ordering product using a Credit Card other than your own is usually quickly declined except in certain circumstances. This delays an order, even if it is validated.
(6) Customers that claim to have sent in age verification and will not respond to our requests for this information.

RETURNS - ABSOLUTELY no returns on used items, loaded ammunition, powder or primers, items not in resalable packaging, or without obtaining a Return Authorization "RA" number which expires 30 days after issuance. We do not accept returns on scopes that have been mounted, closeouts, special order products. Shipping charges are not refundable, A 25% restocking fee, with a minimum restocking fee of $5.00 will be charged on ALL returns except those where we have made an error. Any defective merchandise should be returned to the manufacturer. If you have received merchandise in error, We return products at our cost if we sent the wrong product. No returns accepted after 30 days from the date of invoice. All returns must be prepaid, No return items shipped to J M Company Unlimited LLC, via COD, will be accepted.

VERY IMPORTANT - FIREARM RETURNS  !!  Please take your time to inspect all firearms thoroughly BEFORE proceeding with the transfer. Once a new firearm is transferred to you it is considered used, even if unfired.  Consequently, we cannot provide a full refund for new firearms once they have been transferred into your possession.  Also, we DO NOT reimburse FFL transfer fees on returned items.  We do understand that some manufacturer defects may not be identifiable upon initial inspection.  However, upon discovering a defect AFTER the transfer, the firearm MUST be returned directly to the manufacturer for replacement or repair (in accordance with manufacturer’s warranty policy).  By sending a defective firearm directly to the manufacturer, you can avoid the unnecessary transfer fees of returning the firearm to us through your local FFL dealer.  If we do receive a defective firearm that has already been transferred, we will simply forward the firearm to the manufacturer on your behalf.  Manufacturer repaired firearms can be returned directly to the customer without additional FFL transfer or associated fees.  However, if the manufacturer chooses to replace the firearm, the replacement firearm must transfer through your local FFL dealer to document the replacement firearm serial number.

METHOD OF PAYMENT - We accept Visa, MasterCard, Discover, American Express, certified checks or money orders. We require the 3 digit CID security number located on the back of the card (American Express- 4 digits on the front) in order to process any credit card orders. When paying by credit card, the shipping address must be the same address as where the credit card statement is mailed. Advanced payment by personal or business checks are accepted but will be held 14 days for clearance. We will NOT ship COD.

MINIMUM ORDER – $ 50.00 minimum order required. A $10 fee will be added for handling.

BACKORDERS - We accept backorders. Any backorder less than 30 days old will be shipped without notification, unless shipping COD. Backorders for less than $15 will be cancelled. Items placed on backorder are subject to price changes.

HAZARDOUS MATERIAL - Powder, primers & liquid cleaning chemicals over 1 quart, will be charged a $22.50 hazardous material fee per package. Maximum gross weight per package is 50 lbs. We can mix brands in one package. Minimum order for powder is 5 lbs. Minimum order for primers is 1000. On any backordered hazardous material, you are responsible for the $22.50 hazardous charge. No individual powder containers over 8 lbs. can be shipped. Hazardous materials cannot be shipped Parcel Post. Any hazardous materials (primers, ammo, fuse) cannot be shipped via air. Any type of aerosols, oils and solvents (products with an ORM-D classification) cannot be shipped via air. Black powder must be shipped separately from all other products and a maximum of 25 lbs. may be shipped in one package. Primed hulls, primed brass and ammo does not require a haz mat fee for ground shipping. Hazardous Materials require an adult signature for delivery. ID may be required at delivery for proof of age. In the event that the package is not delivered after 3 attempts or refused, the customer will be responsible for all associated shipping charges including Haz Mat fee.

Large safes. The standard shipping rates do not apply to large safes due to the weight these have to be shipped by a standard freight carrier you will need to contact JM Company Unlimited LLC. to get a shipping quote.

Litigation.  Any legal controversy or legal claim arising out of or relating to this Agreement, our services or products shall be resolved in the jurisdiction of our home office in Shawnee County, Kansas. By making a purchase with us, buyer agrees to submit to the jurisdiction of Shawnee County, Kansas, and specifically waives any defense of lack of personal jurisdiction. We further sets the sum of $1,500.00 as liquidated damages for breach of this agreement above a reasonable attorney's fee.  Access to Ammo-Sale through the Internet shall not be construed as our purposeful availment of the privileges or benefits of doing business in any state or legal jurisdiction other than the State of Kansas. This Agreement shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to it’s conflicts or choice of laws principles. In any legal action arising out of or relating to this Agreement, our services or products, the Shawnee County Court, State of Kansas, shall have sole and exclusive jurisdiction and venue, over such action, or if that court lacks subject matter jurisdiction, the United States District Court for the Middle District of Kansas, shall have sole and exclusive jurisdiction and venue over such action.

General.  This Agreement shall be governed in all respects by the laws of the State of Kansas as such laws are applied to agreements entered into and to be performed entirely within Kansas between Kansas residents. We do not guarantee continuous, uninterrupted, or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or not enforceable, such provision shall be struck and the remaining provisions shall be enforced. You agree that this Agreement and all incorporated agreements may be automatically assigned by us, in our sole discretion, to a third party in the event of a merger or acquisition. Headings are for reference purposes only and in no way define, limit, construe, or describe the scope, or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches by others.

Order Information Privacy and Credit Card Security
We currently use the Secure Sockets Layer (SSL) protocol to safeguard your information, including your credit card number, during online transactions. We believe SSL to be a very safe encryption method.

For your protection, never put your credit card number or other sensitive information in unencrypted e-mail. When we send a confirmation email for your order, we will not include your credit card that you input when you ordered. In the extremely unlikely event that we ever do suspect a customer's credit card number has been intercepted, we will immediately notify the customer.
